CITY COUNCIL MEETING June 20, 2000
The City Council of the City of Bettendorf, Iowa, met in Regular Session on Tuesday, June 20, 2000, at 7:00 PM, at the Bettendorf Public Library Information Center, 2950 Learning Campus Drive.
Council members present were Brown, Freemire, Gordy, LaMar, Ross, Douglas and Voelliger.
Mayor Ann Hutchinson presided.
The invocation was given by Reverend Larry Chandler of the Bettendorf Church of the Nazarene.
Mayor Hutchinson presented a plaque to Iowa State Representative Mona Martin who is retiring at the end of the year, thanking her for her service to the 43rd district and to the citizens of Bettendorf.
There were five public hearings on the regular agenda. Before each hearing was opened, Mayor Hutchinson verified with the council secretary that there had been proper publication of notices of the hearings. The only correspondence received had been as a result of the notice of public hearing on the rezoning of property east of Blackhawk Trail and south of 53rd Avenue.
A letter was sent by Dr. Benjamin Van Raalte who expressed concern regarding the lack of enough access into the proposed new development . Mayor Hutchinson stated that the letter had been placed in the council packets and would be entered into the public record.
The fifth item on the agenda was a public hearing on the matter of the proposed rezoning of land east of Blackhawk Trail and south of 53rd Avenue. Because no one indicated a desire to address the council on the matter, Mayor Hutchinson closed the public hearing.
Discussion
City administrator, Decker Ploehn stated that a meeting had been held with the developer, Bob Walter, regarding the issues that had been raised at the Committee of the Whole meeting on Monday, June 19. The result of the meeting is that staff recommends and Mr. Walter concurs, that the matter should be tabled so that Mr. Walter can pursue the solutions outlined at the Committee of the Whole meeting - either an additional subdivision that would allow an access to Crow Creek Road, or merely an access to Crow Creek Road.
Council Member Gordy made a motion to table the ordinance rezoning the property as stated. Her motion was seconded by Council Member Voelliger.
Roll call on the motion: All ayes. Ordinance tabled.
Mayor Hutchinson then opened public forum which is a time when the public is invited to address the council on issues in general and not those addressed in public hearings. No one rose to address the council and public forum was closed.
The next public hearing was on the matter of the reconstruction of 22nd Street along the community center. Mayor Hutchinson opened the public hearing and closed it when no one rose to address the council.
Council Member LaMar presented a resolution approving plans, specifications and form of contract for the reconstruction of 22nd Street as stated. She then moved to approve and adopt the resolution and her motion was seconded by Council Member Gordy.
Roll call on the motion: all ayes. Resolution number 221-00 attached hereto as annex number one.
Next was a public hearing regarding the installation of a traffic signal light at Kimberly and Lincoln Roads. No one rose to address the council and Mayor Hutchinson closed the public hearing.
Council Member Voelliger then presented a resolution to approve plans and specifications for a traffic signal light at the corner of Lincoln and Kimberly Roads. He then moved to approve and adopt the resolution and his motion was seconded by Council Member Douglas.
Discussion
Council Member Voelliger asked that he city monitor traffic at this intersection to see how much pedestrian traffic there is and to consider whether a pedestrian crossing is or will become necessary.

Next, Mayor Hutchinson opened the public hearing on the matter of plans, specifications and form of contract for the paving of Mississippi Boulevard from 10th Street to Hall Street and west of 8th Street. Ms. Marg Lake, of Mississippi Boulevard, rose to state that she thought the paving was a great idea. No one else got up to address the council and Mayor Hutchinson closed the public hearing.
Council Member Brown presented a resolution to approve the plans, specifications and form of contract as stated. Council Member Freemire seconded her motion.
Roll call on the motion: all ayes. Resolution number 223-00 attached hereto as annex number three.
The final public hearing was regarding the taking of bids for demand response bus service and Saturday bus service. Mayor Hutchinson opened the public hearing and closed it when no one rose to address the council.
Council Member Douglas presented a resolution to approve the taking of bids as stated. Council Member Voelliger seconded his motion.
Discussion
Council Member Voelliger and the city administrator discussed the fares charged to riders of the transit system. The city does not break even on the cost of the service, but follows the trends and what the market will bear. City staff feel that if the city charged enough to break even, there would be no riders, and it is felt that bus service is a valuable service. Any potential change would be discussed at budget meetings.

Council Member Freemire presented the first reading of an ordinance making changes to the traffic code - Chapter 17 of the Municipal Code. Mr. Freemire moved to waive the rule regarding the reading of an ordinance three times before voting for passage. Council Member Gordy seconded his motion to waive the rules.
Discussion
Council Member Voelliger asked for clarification on the part of the ordinance change which would allow the police to cite someone for cutting through private drives/parking lots to avoid traffic lights. Mr. Voelliger wanted clarification that in a case such as at JoeVan's where there is a mailbox in the parking lot, that is a situation not addressed by this ordinance change. The city attorney responded by saying that the ordinance is intended to allow the police to cite someone who has cut through a corner lot such as MiddleMart to avoid a traffic signal, and who stops and waits in the private lot until the police are gone.

Council Member Freemire then moved to approve and adopt the ordinance making changes to the traffic code. Council Member Ross seconded his motion.

Next, Mayor Hutchinson entertained a motion for the approval of the consent agenda. Council Member Freemire moved to approve the consent agenda and his motion was seconded by Council Member Voelliger.

Resolution number 225-00 ordering the installation of three hydrants in Pleasant Ridge Additions. attached hereto as Annex number six.
Resolution number 226-00 accepting subdivision improvements for Brookview Heights, 1st Addition, portion of the storm sewer attached hereto as Annex number seven.
Resolution number 227-00 accepting subdivision improvements for Century Heights 8th Addition sanitary sewer attached hereto as Annex number eight.
Resolution 228-00 accepting subdivision improvements for Valleywynds.2nd Addition street paving attached hereto as Annex number nine.
Resolution 229-00 setting a date for public hearing for opening 21st Street from Cody Street to Glenn Street attached hereto as Annex number ten.
Resolution 230-00 setting a date for public hearing and directing the advertising for bids for Forest Grove Drive ditch grading improvements from Golf Course Road to Eagle Ridge Road attached hereto as Annex number eleven.
Resolution 231-00 accepting improvements of the 23rd Street curb and gutter, 23rd Street pool entrance relocation and Hillside Drive widening projects attached hereto as Annex number twelve.
Resolution 232-00 authorizing the city of Bettendorf Police Department to enter into a 28E agreement with the city of Davenport for a police shared computerized record system attached hereto as Annex number thirteen.
Resolution 233-00 approving renewal of a Class C liquor license (on premises) and Sunday sales privilege for ANJ, Ltd. d.b.a. the Tiddley Tap, 340 - 16th Street attached hereto as Annex number fourteen.
Resolution 234-00 approving new Class B beer permit (on premises) and Sunday sales privilege for T&J, L.L.C., d.b.a. Los Amigos Restaurant, 2322 Spruce Hills Drive attached hereto as Annex number fifteen.
Resolution 235-00 approving a new Class C liquor license (on premises) and Sunday sales privilege for the Paddlewheel Restaurant, Ltd. d.b.a. Paddlewheel Sports Bar and Grill, 221 - 15th Street attached hereto as Annex number sixteen.
Resolution 236-00 in support of option 16 in keeping the area 319 intact in the Quad City area attached hereto as Annex number seventeen.
The minutes from the regular council meeting held on June 6, 2000 were considered, approved, adopted, and placed on file for future reference.
Bills considered, approved, and adopted and the city clerk was directed to write checks for the respective amounts.
On motion by Gordy, seconded by Voelliger, the council meeting was adjourned.

The City Council of the City of Bettendorf, Iowa, met in Regular Session on Tuesday, June 6, 2000, at 7:00 PM, at the Bettendorf Public Library Information Center, 2950 Learning Campus Drive.
Council members present were Brown, Freemire, Gordy, LaMar, Ross, Douglas and Voelliger.
Mayor Ann Hutchinson presided.
The invocation was given by Reverend Realff Ottesen.
Mayor Hutchinson presented a proclamation to Rev. Ottesen thanking him for 25 years of service to the community as First Assistant County Attorney and for being an active participant in community events as well. Wednesday, June 07, 2000 was proclaimed "Realff Ottesen Day" in the city of Bettendorf.
Next on the agenda was public forum. Mayor Hutchinson opened public forum and closed it when no one rose to address the council.
Item 4 on the agenda was a public hearing on the matter of plans and specifications for drain tile and small sewer repair in the year 2000. The council secretary verified that notice of hearing had been published and no correspondence or other communication from the public had been received after the publication.
Mayor Hutchinson opened the public hearing as scheduled and as no one rose to address the council in the public hearing, public hearing was closed.
Council Member Douglas then presented a resolution approving the plans and specifications for 2000 drain tile and small sewer repair. Mr. Douglas moved to approve and adopt the resolution and his motion was seconded by Council Member LaMar.
Roll call on the motion - all ayes. Resolution number 205-00 is attached hereto as Annex number 1.
Council Member Freemire then presented the first reading of an ordinance amending chapter 17 of the Municipal Code entitled "Motor Vehicles and Traffic" by deleting the yield intersection at Magnolia Drive and Magnolia Court.
Mr. Freemire moved to waive the rule for three readings of an ordinance and his motion was seconded by Council Member Voelliger.
Roll call on the motion to waive the rules - all ayes. Rules waived.
Mr. Freemire then moved to approve and adopt the ordinance as read.

Next, Council Member Ross presented the first reading of an ordinance amending chapter 17 of the Municipal Code entitled "Motor Vehicles and Traffic" by adding a stop intersection at Magnolia Drive and Magnolia Court.
Mr. Ross moved to waive the rule for three readings of an ordinance and his motion was seconded by Council Member Gordy.
Roll call on the motion to waive the rules - all ayes. Rules waived.
Mr. Ross then moved to approve and adopt the ordinance as read. His motion was seconded by Council Member Voelliger.

Council Member Gordy then presented the second reading of an ordinance to amend zoning ordinance sections 15.71 and 15.73 allowing residential uses in the C-7 public gathering and recreational activity district as a special use. Ms. Gordy moved to waive the rule requiring three readings of an ordinance and her motion was seconded by Council Member Voelliger.

Ms. Gordy then moved to approve and adopt the ordinance as read. Her motion was seconded by Council Member Ross.

Council Member Voelliger then presented the second reading of an ordinance to amend Appendix B, zoning ordinance section 21.10(e)(9). Mr. Voelliger moved to waive the rule requiring three readings of an ordinance and his motion was seconded by Council Member Douglas.

Mr. Voelliger then moved to approve and adopt the ordinance as read. His motion was seconded by Council Member Freemire.

Council Member LaMar then presented the second reading of an ordinance to amend chapter 5, section of the Municipal Code entitled "Animals" eliminating the late fee for the purchase of dog licenses. Ms. LaMar moved to waive the rule requiring three readings of an ordinance and her motion was seconded by Council Member Voelliger.

Ms. LaMar then moved to approve and adopt the ordinance as read. Her motion was seconded by Council Member Voelliger.

Next, Mayor Hutchinson entertained a motion for the approval of the consent agenda. Council Member LaMar moved to approve the agenda and her motion was seconded by Council Member Voelliger.

Resolution number 206-00 approving a site development plan for ground located at 2500 Grant Street, submitted by Iowa Masonic Nursing Home attached hereto as Annex # 7.

Resolution number 208-00 approving the final plat of Belmont Meadows, 2nd Addition, attached hereto as Annex # 9.
Resolution 209-00 confirming the mayor's appointment of Patricia Lambert to the Building Board of Appeals attached hereto as Annex # 10.
Resolution 210-00 authorizing the purchase of two 2000 Ford Ranger trucks with extended cabs attached hereto as Annex # 11.
Resolution 211-00 awarding bid and authorizing the city administrator to enter into an agreement with Electronic Communication Systems for the communication system in the new council chambers attached hereto as Annex # 12.
