CITY COUNCIL MEETING
November 2, 1999
The city council of the city of Bettendorf, Iowa, met in regular session on Tuesday, November 2, 1999, at 7:00 PM, at the Bettendorf Public Library Information Center, 2950 Learning Campus Drive.
Council Members present were LaMar, McCutcheon, Sundholm, Gordy, Voelliger, and Douglas. Council Member Senneff was absent.
Mayor Ann Hutchinson presided.
Greg Jager, city attorney, gave the invocation.
Public forum was next on the agenda.
The mayor opened public forum.
Mr. Dan Breathaur of 2104 Oak Street, Bettendorf addressed the council on the matter of the tickets issued to people who parked their cars facing the wrong direction on Bettendorf streets. He stated that although he got a ticket, his real reason for attending the meeting is loud car stereos.
He asserted that if the city were going to enforce one law such as the parking law because one alderman asked them to, then he would like to see the noise law enforced as well.
Mr. Breathaurs complaint was regarding the loud car stereos. Mayor Hutchinson agreed that loud stereos are a problem, but that the problem was in enforcing the ordinance because of the difficulty of catching drivers who play their stereos too loud. Mr. Breathaur stated that Rock Island was enforcing their ordinance and perhaps Bettendorf could learn from them.
Alderman McCutcheon asked Mr. Breathaur to clarify the statement that one alderman had caused the enforcement of the parking ordinance.
Mr. Breathaur stated that a neighbor of his had heard on the news that one alderman had stated that there were too many people in Bettendorf parking their cars facing the wrong direction.
Mr. Breathaur reiterated that since one alderman could get the parking law enforced, then surely all that was needed was for one alderman to ask that the noise law be enforced.
Mr. McCutcheon stated that he did not think one alderman was the primary force to get the ordinance enforced, but he felt that since there was an ordinance, it should be enforced.
He also stated that any city ordinance should be enforced as a matter of policy and he agreed with Mr. Breathaur as to the loud car stereos.
After further discussion, Alderman LaMar spoke up to say that if there was one alderman responsible for the enforcement of the parking laws, she supposed that she was that alderman.
Ms. LaMar stated that she had brought the matter of the parking problem to the attention of the city officials because she was concerned over the inherent dangers. People look for cars to pull out of parking spaces on the right and head in the same direction as their own cars. It is not expected that people will pull out of a spot on the left side of the road and head in the same direction as the driverís car.
Ms. LaMar stated that attempts had been previously made to enforce the noise ordinance as to the loud stereos. When citizens make a complaint, they need to be able to provide a good description of the car and/or the license plate number. Otherwise, the car is gone by the time a patrol car can respond.
Mr. Breathaur suggested stiffer penalties for violation of the noise law, much as the stiff penalties for parking in a handicap parking zone.
Mayor Hutchinson then closed the public hearing.
Item no. 4 on the agenda was Council Member Voelligers presentation of an ordinance to amend Chapter 17 of the Municipal Code entitled Motor Vehicles and Traffic, Driving Rules for Specific Intersections as to the intersection of Lincoln Road and Kimberly Ridge Road.
Mr. Voelliger moved to waive the rule to read an ordinance three times and his motion was seconded by Council Member Douglas.
Roll call on the motion to waive the rules: all ayes. Motion carried.
Mr. Voelliger then moved to approve the ordinance and that motion was seconded by Mr. Douglas.

Mayor Hutchinson then proclaimed the week of November 21 - 27 as National Family Week and proclaimed the week of November 21 - 28 as National Bible Week.
The mayor then entertained a motion for approval of the consent agenda and Council Member Voelliger so moved. Mr. Douglasís motion was seconded by Council Member Gordy.
Roll call on the motion to approve the consent agenda: all ayes. Motion carried.
The following items were enacted by one motion as a result of the adoption of the consent agenda.
Resolution no. 379-99 attached hereto as Annex #2 activating deficiency assessments - 53rd Avenue paving and Barcelona Street paving.
Resolution no. 380-99 attached hereto as Annex #3 activating deficiency assessments and terminating agricultural deferment - 53rd Avenue extension paving from Barcelona Street to Devils Glen Road.
Resolution no. 381-99 attached hereto as Annex #4 terminating agricultural deferment - Devils Glen Road paving from Crow Creek Park to 53rd Avenue.
Resolution no. 382-99 attached hereto as Annex #5 approving snow removal policy on streets/alleys.
Resolution no. 383-99 attached hereto as Annex #6 accepting street improvements for 1999 curb and gutter project.
Preliminary resolution no. 384-99 for 2000 curb and gutter attached hereto as Annex #7.
Resolution no. 385-99 attached hereto as Annex #8 authorizing the director of public works to enter into a contract with Missman-Stanley and Associates for preparation of a stormwater management plan.
Resolution no. 386-99 attached hereto as Annex #9 accepting street improvements for Mississippi Boulevard paving from 4th Street to 6th Street.
Resolution no. 387-99 attached hereto as Annex #10 renewing the Class C beer permit, Class ìBî wine permit, and Sunday sales privilege for Eagle Food Centers, Inc. d.b.a. Eagle Food Center #089 at 2701 Devils Glen Road.
Resolution no. 388-99 attached hereto as Annex #11 approving the site development plan for property located at the southeast corner of Crow Creek Road and Utica Ridge Road.
Resolution no. 389-99 attached hereto as Annex #12 approving the site development plan for property located at 1710 Grant Street.
Resolution no. 390-99 attached hereto as Annex #13 approving the replat of Lot 3, Steamboat Landing 2nd Addition.
Resolution no. 391-99 attached hereto as Annex #14 setting the rates for snow removal from sidewalks for 1999-2000.
Consideration of the minutes from the regular council meeting held on October 19, 1999. (Approved, adopted, and attached hereto as Annex #15.
Bills. (Approved, adopted and directed the city clerk to write checks for the respective amounts).
Council Member Gordy moved for adjournment, was seconded by Council Member Voelliger and Mayor Hutchinson adjourned the council meeting.
